Why I should not use photos and texts without written permission for my own purposes... especially not for auction descriptions.

Respect Building and maintaining a website is very labor-intensive. Hundreds of photos had to be created and post-processed on the computer. Information about these writing instruments was gathered from various sources.

Please do not use the content of this website for your own purposes.

Copyright

All photos are protected under the creator principle by §7 of the German Copyright Act (UrhG). Only the person who created the photo has the sole right to its exploitation.
Please also note that parts of photos are covered by §7 of the German Copyright Act (UrhG).

Copyrights do not need to be marked within the photos, as copyright automatically rests with the photographer.

If a photo is published (after permission from the photographer), the photographer has the right to be credited by name or source.

If a photo is published without the photographer's consent, the photographer has the right to claim damages, which is typically higher than the "normal" photographer's fee.

Copyright does not expire until 70 years after the death of the photographer.

eBay Terms and Conditions 		In §8 Section 5 of eBay's Terms and Conditions, it is stipulated that photos must not violate the rights of third parties.
If you use photos without permission, you violate not only the German Copyright Act but also eBay's Terms and Conditions.

Right III

Photos with goods
in auctions 		The buyer / highest bidder of an auction has the right to demand the EXACT item shown in the photos.

If you use photos from this website, this is not possible.

It is also highly problematic if you use photos from this website but your writing instrument has a defect that the buyer cannot detect through the use of our photos. In this case, the buyer can rely on the photo (District Court Trier, Az. 1 S 21/03).


Please do not use photos from the website www.fountainpen.de without prior written permission. This will save both you and us a lot of work.
